Woman who fell 80ft to her death days after revenge porn threat ‘may have been pushed’

A woman who fell 80ft to her death days after her boyfriend threatened to ‘destroy’ her with a revenge porn video may have been pushed, a coroner was told today.

Damilya Jossipalenya, 24, died on June 3, 2017, a week after her then boyfriend Alessio Bianchi had threatened to send embarrassing intimate videos of her to her family.

But CCTV near her London apartment block shows Ms Jossipalenya falling ‘like a brick’, said Assistant Coroner Bernard Richmond QC.

He added that she had written a suicide note to her Kazakh parents in ‘very poor English’.

A seven-day jury inquest into what happened is now fixed for July 7, just over four years after her death, a pre-inquest review heard today.

The Kazakh student’s family will ask jurors to consider whether she suffered an unlawful killing, the court heard.

Jurors will also consider her right to life and whether the police met their safeguarding obligations given the background of violence in the relationship.

Bianchi, the Metropolitan police, the Independent Office for Police Conduct and Ms Jossipalenya’s family will all be interested parties in the inquest.

Bianchi or a lawyer representing him were not present at the inquest, so Mr Richmond issued a summons for him to appear on Tuesday, June 1.

The family’s lawyer Saba Naqshbandi said: ‘You’ve heard our concerns, in respect to the relationship, the police response to assault and their response on the evening.’

‘It’s ‘did she jump, or was she pushed?’ in the starkest terms,’ said Mr Richmond.

‘The jury are going to have to form a view as to whether or not she formed a settled decision to kill herself, you’re asserting that one thing you want to consider is unlawful killing.

‘Is she the sort of person who would have taken her own life? Therefore those who knew her best and loved her most are in the best position to form that view.

‘This woman was an educated woman and those notes are written in very poor English, given that she was studying at Regents College in English, that would be surprising.

‘I also want to know why she was writing to her parents in English, and whether the pen on the bed was tested forensically, because is that the pen one assumes is with which suicide note was meant to be written.

‘Otherwise she scrawled notes in the most slapdash fashion, put the pen away neatly and fell, not a great height, but was observed to fall like a brick.

‘The pathologist will help with that and whether that is normal for a fall.

‘I take the view about inquests that very often the job is to provide a voice to the one person who can’t speak.

‘If she were here I’m sure she would want to tell us about the context of either doing what she did or what was done to her, these things don’t just come out the blue do they?’

‘What really matters to the family here is what happened? Did she take her own life? Or was there a darker explanation.

Ms Naqshbandi added: ‘Of course the jury will have to consider whether this was an accident.’

The family were frustrated that the Met have failed to provide a statement about their full position since December 2019.

‘We’ve had nothing, we are keen to make progress,’ said Ms Naqshbandi.

‘Once we have that we will understand what the Metropolitan Police’s response is to family concerns which have been clear for years now.’

It is ‘regrettable’ that concerns voiced about a lack of statement from a person who was also ‘at the apartment’ had also not been taken into account, Ms Naqshabandi added.

Three days before her death 26-year-old Italian Bianchi pushed her out of his Paddington apartment during a row and threw her into the water feature outside.

In April 2018, Bianchi was spared jail after admitting disclosing private sexual photographs and films with intent to cause distress and one count of assault by beating.

He was handed a 12-week suspended sentence, ordered to carry out a rehabilitation activity requirement and made to pay £250 costs.

Bianchi called 999 shortly before 1am on June 3 to report his girlfriend was in a distressed state.

The responding officers were later criticised for spending around 40 minutes chatting to him in his apartment, only arriving at Ms Jossipalenya’s home nearby at around 1.30am – ten minutes after she plunged to her death.

Bianchi and Ms Jossipalenya had been in a relationship for two-and-a-half years, on and off, leading up to May 2017.

She told police that there had been a row at his apartment on 12 May and he had ‘grabbed her by the throat, struck her four or five times, spat on her and that she had passed out for a few seconds.’

The couple’s friends at Regent’s University were aware of their tumultuous relationship and Bianchi had reported her to police himself on several occasions, when she had scratched him and she had attempted suicide.

She was sent a video recording on WhatsApp of her performing oral sex at a phone booth in north London, on May 25, 2017.

Attached was a message saying: ‘I am going to keep destroying you.’

One of her friends received the same clip from three different numbers, with one containing the threat: ‘I will f**k you up next, my love.’

When Bianchi’s phone was seized by police on 1 June they found WhatsApp messages in which he had asked his friend to send the video to Ms Jossipalenya.

She reported the sending of the revenge porn to the police but continued the relationship afterwards.

Ms Jossipalenya told police she did not know she was being recorded in the phone booth.

‘I found it really insulting and humiliating, I think he’s doing this for revenge because of the argument,’ she explained.

‘I am still in shock and feel broken.’

She said she was ‘very scared mentally and physically’ because Bianchi had threatened to send the porn video, as well as footage of her taking cocaine, to her family.

On 1 June the pair went out drinking with friends, arriving back at Bianchi’s apartment at around 11.30pm.

They had an argument before Bianchi pushed Ms Jossipalenya into the water feature in front of the building.

The violence outside the building lasted for over half an hour before the concierge called police and in the early hours of June 2.

Bianchi was arrested and had his phone seized. The next day he received distraught text messages, similar to those he said he had received in the past, from Ms Jossipalenya.

He called police and rushed to her apartment but found her dead on the ground.

She had left a note which read: ‘Alessio I love you, sorry.’

The sight of his lover crumpled on the pavement has had a lasting impact on Bianchi, who has received treatment at the Nightingale Hospital for PTSD and complex bereavement disorder.

Bianchi was born in Jeddah, Saudi Arabia, where his father works and he moved to London in 2009 to study at Regent’s University.

A statement from Ms Jossipalenya’s family, who are from Kazakhstan, said: ‘We cannot describe the pain we feel of losing our beloved Damilya.

‘She was such an adorable, wonderful, loving, caring and intelligent girl.

‘She loves everyone with all of her heart and tried to see the good in everyone she encountered.

‘We are heartbroken to hear the details of the abuse and torment in which our daughter had to endure because of Mr Bianchi.

‘She had a bright future ahead of her and had so many dreams and aspirations to accomplish great things.

‘While we mourn the loss of a very good girl, we also celebrate her remarkable life and hope that the memory will live on in all that know her.’

A full inquest will begin on July 7.
